Értékelve volt a szabadalom, de az értékelés eredményét Ducsai elfelejtette megemlíteni az interjúban.

Hogy a "feltalálói lépés" kritériumon nem ment át, mert nem különbözik érdemben egy korábbi szabadalomtól, helyette bullshitelnek “költséghatékonyság”-ról aminek semmi helye egy szabadalom szövegében.

The problem to be solved by the invention is not clear because the meanings of terms such as "cheap”, "cost-effective" or "operation and maintenance costs” always depend on the current economic and market situation and are therefore not clear, and "relatively easy to scale up” is subjective. Consequently, the description does not clearly contain the objective technical problem to be solved by the present invention, so that the problem-solution analysis cannot be carried out to assess the involvement of an inventive step [...]. Consequently, with such an unclear objective, compliance with PCT Article 33(3) cannot be demonstrated and cannot be accepted.

Disregarding the unclear terms, the problem to be solved by the invention is as follows:(a) to provide a solution for the temporary storage of energy in gas, preferably hydrogen, and its retrieval, even for stand-alone domestic power plants or large grid-connected power plants;(b) to provide an energy storage system that can be used for both stand-alone domestic power plants and large grid-connected power plants, i.e. with a capacity that can be adapted to the needs of the producers and/or users and that can be scaled up in terms of storage capacity. As the only difference between the storage systems described in independent claim 1 and that disclosed in document D1 is where the water displaced by the hydrogen is removed from the cartridge (whether from the object/well to the surrounding geological formation where it mixes with the groundwater and then back again, or to the top of the object/well), both systems are able to solve both (a) and (b). The two systems are therefore equivalent variants of each other in terms of the problem to be solved. Since the energy storage system described in independent claim 1 is only an equivalent variant of the system disclosed in prior art document D1, it is obvious to a person skilled in the art. Consequently, independent claim 1 does not involve an inventive step and therefore does not comply with PCT Article 33(3). The additional features of dependent claims 2–6 are considered to be merely of a constructional type, which lie within the normal design competence of a person skilled in the art, and the description does not contain any unexpected effect that is attributable to these merely constructional features. Consequently, said claims do not involve an inventive step and therefore do not comply with PCT Article 33(3).
